Terms of Service

These Terms of Service ("Terms") govern your use of FreeMyMemories.

"FreeMyMemories," "we," "us," and "our" mean DIRK DOUGLAS MILLER.

FreeMyMemories is independent from Snap Inc. and Snapchat. FreeMyMemories is not sponsored, endorsed, approved, or operated by Snap Inc.

1. Acceptance

By downloading, accessing, purchasing, restoring, or using FreeMyMemories after these Terms are made available to you, you agree to these Terms to the maximum extent permitted by law and Apple's applicable terms. If you do not agree, do not use FreeMyMemories.

These Terms contain warranty disclaimers, data-loss disclaimers, liability limits, and indemnity obligations, all to the maximum extent permitted by law.

If you use FreeMyMemories on behalf of another person or organization, you represent that you have authority to do so and that you will comply with these Terms.

2. Apple Terms

FreeMyMemories is distributed through the Apple App Store. Apps made available through the App Store are licensed, not sold.

The Apple Standard EULA governs the App Store license unless App Store Connect identifies a custom license agreement for FreeMyMemories in the applicable App Store country or region. These Terms supplement the Apple Standard EULA with FreeMyMemories rules for app use, support, content, purchases, privacy, liability, dispute resolution, and availability. These Terms are not a custom EULA unless App Store Connect expressly identifies them as one.

If these Terms conflict with the Apple Standard EULA, Apple's App Store terms, or non-waivable rights that apply to you, the applicable Apple terms or non-waivable rights control to the extent of the conflict.

Apple is not responsible for FreeMyMemories support or maintenance except where Apple's own terms or applicable law require otherwise. Apple and its subsidiaries can enforce rights under the Apple Standard EULA where that agreement gives them third-party beneficiary rights.

3. Eligibility

FreeMyMemories is a general-audience app and is not directed to children.

If you are under the age of majority where you live, you can use FreeMyMemories only with permission from a parent or guardian where applicable law requires it.

You cannot use FreeMyMemories if law, sanctions, export controls, App Store rules, or these Terms prohibit your use.

4. App Function

FreeMyMemories provides local tools to import, organize, view, search, map, export, and manage Memories and related metadata from export files or export links you provide.

FreeMyMemories is local-first. You do not need a FreeMyMemories account. FreeMyMemories does not operate an app account system, app backend, server-side import pipeline, remote media library, remote database, remote backup service, or cloud storage service for imported Memories.

FreeMyMemories does not log in to Snapchat for you, does not ask for your Snapchat password, does not use Snap OAuth or Snap Kit, does not use any Snap developer SDK, and does not use any Snap/Snapchat API or platform integration.

5. No Guarantees From Third Parties

FreeMyMemories depends on files, links, devices, operating systems, app stores, and third-party services that FreeMyMemories does not control. Export links and signed media URLs can expire, be revoked, stop working, require network access, or change format. Third-party services can change export tools, file structures, link behavior, rate limits, metadata formats, authentication rules, or availability without notice to FreeMyMemories.

FreeMyMemories does not guarantee that every export file, export link, media URL, photo, video, caption, timestamp, location, or metadata field can be imported, parsed, repaired, displayed, mapped, searched, or exported perfectly. Metadata can be incomplete, missing, inaccurate, inconsistent, or unavailable.

FreeMyMemories does not recover content that is not present in your export, is no longer available from a link, was deleted from your device, was removed by a third party, was excluded from a backup, or is unavailable because of your storage or backup choices.

FreeMyMemories is not an emergency service, archival storage service, backup service, legal service, or guaranteed data recovery service.

6. Your Responsibilities

You are responsible for:

  • importing only files, links, photos, videos, captions, locations, and other content that you own or have the right to use;
  • complying with Snapchat's rules, Apple's rules, device rules, backup-service rules, and other third-party terms that apply to services you use;
  • keeping your device, Apple Account, Snapchat account, export ZIPs, signed URLs, backups, and exported files secure;
  • maintaining backups of important content outside FreeMyMemories;
  • verifying that your content is safely backed up before importing, deleting, exporting, editing, sharing, or changing storage settings;
  • reviewing exports before sharing, saving, or sending them;
  • ensuring your use of FreeMyMemories is lawful where you are located.

You cannot use FreeMyMemories to violate rights, break the law, bypass technical protections, misrepresent affiliation with Snap Inc., interfere with the app or FreeMyMemories-controlled support/legal services, attack or scrape FreeMyMemories systems, or reverse engineer the app except where applicable law gives you a non-waivable right to do so.

7. Your Content

Your Memories and imported content remain yours. These Terms do not transfer ownership of your photos, videos, captions, metadata, export files, or other personal content to FreeMyMemories.

FreeMyMemories does not need rights to host, publish, or remotely store app-local Memories because FreeMyMemories does not receive app-local Memories during ordinary app use.

If you send support messages, diagnostics, screenshots, files, attachments, feedback, or other content to FreeMyMemories, you grant FreeMyMemories the right to use that submitted material to respond to you, troubleshoot, operate and protect FreeMyMemories, maintain appropriate records, and comply with legal, security, tax, abuse, payment, or dispute obligations.

Do not send sensitive Memories files, export ZIPs, signed URLs, screenshots, or other private content to support unless the support issue requires it and you decide to send it.

If you send sensitive material to support, FreeMyMemories can open and review that material only as needed to handle the support request, protect the app or support channel, or satisfy legal, security, abuse, payment, tax, or dispute obligations. You can request deletion of support material FreeMyMemories controls, subject to legally required or reasonably necessary retention.

8. Local Data

FreeMyMemories stores app-managed data locally on your device. Durable app data, including the app database and archive, can be included in Apple device or iCloud backups depending on your Apple settings and backup configuration.

The app includes deletion controls for app-managed local Memories, archive files, local import diagnostics, import jobs, import receipts, and related import/archive records from your device.

Deleting app data inside FreeMyMemories does not delete original export files outside the app container; copies saved to Photos, Files, iCloud, email, another app, or another service; exports shared with other people; Apple purchase records; App Store receipts; refund records; Apple Account records; Snapchat-side account data; Snapchat export records; device backups; iCloud backups; unsent local support or review/rating drafts unless the deletion flow says they are included; or support emails, attachments, or diagnostics already sent to FreeMyMemories.

Temporary files, caches, thumbnails, overlays, staging files, and other regenerable app files can contain user media or metadata. They are app-local files. The app or iOS can regenerate or remove non-durable files. Durable archive and database data remains retained local archive data until deleted by app controls, app deletion, device controls, or OS behavior.

You are responsible for deciding whether to keep backups before deleting local app data.

FreeMyMemories is not responsible for data, content, metadata, links, files, exports, backups, or copies that are lost, deleted, corrupted, unavailable, incomplete, inaccurate, inaccessible, overwritten, excluded from backup, changed by a third party, changed by iOS, changed by Apple settings, or changed by a destination service, except to the extent liability cannot be excluded by applicable law.

9. Exports

When you export Memories, save to Photos, save to Files, share through another app, send an email, or choose another destination, the exported copy leaves the FreeMyMemories local app archive and is controlled by that destination.

Exports can include media content, timestamps, captions, location metadata, overlays, manifests, and other metadata depending on the source data, export options, and destination.

FreeMyMemories is not responsible for third-party destinations, their privacy practices, metadata handling, backups, deletion behavior, availability, or security.

10. No Backup Or Recovery Service

FreeMyMemories is not a backup service, archive custodian, cloud storage provider, media recovery service, forensic recovery service, records-retention service, or guaranteed preservation tool.

FreeMyMemories has no obligation or ability to restore app-local Memories, local databases, local archive files, export ZIPs, signed URLs, thumbnails, caches, exports, Photos copies, Files copies, iCloud copies, device backups, email attachments, third-party copies, Snapchat-side records, Apple-side records, or support materials that FreeMyMemories no longer controls.

You assume the risk of using local device storage, third-party exports, temporary links, device backups, Apple services, cloud services, email, Files, Photos, and other destinations. You are responsible for keeping independent backups before using any destructive, import, export, cleanup, restore, sharing, storage-management, or deletion feature.

11. Purchases

If Lifetime Unlock is offered in your App Store storefront, it is a one-time, non-consumable in-app purchase through Apple's StoreKit system. Lifetime Unlock is not a subscription.

"Lifetime Unlock" means a non-subscription unlock, for the Apple Account Apple associates with the purchase, of the paid FreeMyMemories features described on the purchase screen at purchase time. It does not mean your lifetime, our lifetime, perpetual maintenance, perpetual compatibility, or permanent availability of every feature, export source, operating system, device, third-party service, or App Store country.

The price, included taxes, purchase conditions, refund process, payment method, storefront, purchase record, receipt, invoice, and Apple Account purchase history are handled by Apple under Apple's terms and privacy practices.

Restore Purchases asks Apple for the current entitlement associated with the same Apple Account. If Apple reports that a purchase is refunded, revoked, unverified, unavailable, not associated with your Apple Account, or otherwise not valid, FreeMyMemories can lock paid features again.

If a paid feature included in Lifetime Unlock is materially reduced or discontinued, contact [email protected] so FreeMyMemories can review the issue and direct you to Apple's refund process or any mandatory remedy that applies.

Family Sharing is disabled for Lifetime Unlock unless Apple's App Store listing for FreeMyMemories says otherwise.

12. Support

FreeMyMemories support is available through [email protected] and the support page at https://freemymemories.com/support.

Support is not an emergency service, archival storage service, legal service, backup service, or guaranteed data recovery service. FreeMyMemories cannot recover deleted local Memories, unavailable exports, expired links, missing metadata, files outside the app, device backups, or third-party account data unless the needed data still exists in a place FreeMyMemories can lawfully access with your help.

The app can create a support snapshot or diagnostic summary. Diagnostics are optional and user-initiated. Review what the app shows before sending it.

Apple displays App Store trader contact details where Apple requires them. A public trader phone number, if listed by Apple, is trader contact information and does not mean FreeMyMemories offers phone support unless FreeMyMemories expressly says it offers phone support.

13. Privacy

Your use of FreeMyMemories is governed by the FreeMyMemories Privacy Policy at https://freemymemories.com/privacy.

The Privacy Policy explains local processing, support diagnostics, Apple purchase flows, exports, deletion limits, and privacy request handling.

14. Third Parties

The app can link to or interact with third-party services, including Apple, Snapchat, Google Cloud Storage, your email provider, Photos, Files, iCloud, and other apps or services you choose.

FreeMyMemories hosts app legal pages, app support information, and contact information at freemymemories.com. You do not need to use the website to use the app except when you choose to open hosted legal or support pages.

FreeMyMemories is not responsible for third-party services, third-party content, third-party terms, third-party privacy practices, third-party availability, third-party security, third-party backups, third-party changes, or third-party deletion behavior.

15. Availability

FreeMyMemories is available only where Apple and FreeMyMemories make it available. Availability is controlled by App Store country, region, and storefront settings and can change because of Apple, law, sanctions, export controls, payment restrictions, tax or banking restrictions, support limits, local-language requirements, or launch decisions.

Availability in a country or region does not mean the app UI, support, legal documents, or review responses are available in that country's local language. Non-English App Store metadata does not mean localized app UI, localized support, localized legal documents, or localized review responses are available. Mandatory local-language notices, consumer disclosures, privacy processes, and non-waivable rights control where applicable law requires them.

16. Sanctions And Export Controls

You cannot use, export, re-export, download, access, or transfer FreeMyMemories in violation of U.S. export controls, sanctions, App Store rules, or other applicable laws.

You cannot use FreeMyMemories if you are located in, ordinarily resident in, or organized under the laws of a country, region, government, entity, or person subject to restrictions that make your use unlawful, or if you are on a restricted-party list that makes use unlawful.

FreeMyMemories can limit App Store availability, app updates, paid entitlement availability, support access, or future distribution where Apple, law, sanctions, export controls, payment systems, or compliance requirements require or justify the limit.

Because FreeMyMemories has no app account backend and no remote storage for imported Memories, FreeMyMemories cannot remotely disable app-local data or already-downloaded local functionality except through Apple-controlled distribution, StoreKit entitlement behavior, updates, or features that depend on external services.

17. Intellectual Property

FreeMyMemories and its app, designs, software, logos, names, copy, and other materials are owned by FreeMyMemories or its licensors, except for your content and third-party materials.

Snapchat, Snap, and related names or marks belong to Snap Inc. Apple, App Store, StoreKit, iCloud, iOS, TestFlight, and related names or marks belong to Apple Inc. Google Cloud Storage and related names or marks belong to Google or its affiliates. Other names and marks belong to their owners.

You cannot use FreeMyMemories branding in a way that suggests sponsorship, endorsement, or affiliation without written permission.

18. Feedback

If you send ideas, feedback, bug reports, suggestions, feature requests, or other comments, you grant FreeMyMemories the right to use that feedback without compensation or obligation to you when the feedback is non-confidential and is non-personal or has been redacted or aggregated so it is no longer reasonably identifiable to you, subject to the Privacy Policy and applicable law. Do not send confidential information unless FreeMyMemories has agreed in writing to receive it.

19. Changes And Discontinuation

FreeMyMemories can update, change, suspend, discontinue, limit, or remove FreeMyMemories or parts of it, subject to applicable law, Apple terms, non-waivable consumer rights, and mandatory remedies. FreeMyMemories can stop supporting old app versions, operating systems, export formats, StoreKit configurations, or support workflows.

If FreeMyMemories materially reduces or discontinues a paid feature included in Lifetime Unlock, any mandatory remedy is governed by applicable law, Apple's App Store terms, Apple's refund process, and non-waivable consumer rights. FreeMyMemories does not process App Store refunds directly. Apple handles App Store refunds where available.

If you violate these Terms or use FreeMyMemories unlawfully, FreeMyMemories can suspend, terminate, or restrict your access to FreeMyMemories support, future services, updates, or other FreeMyMemories-controlled access to the extent permitted by law.

Restrictions for misuse do not limit legally required privacy, security, refund, consumer-rights, or trader-contact channels that FreeMyMemories must keep available under applicable law.

FreeMyMemories can update these Terms. Material changes apply prospectively unless applicable law or App Store rules allow another effective date. FreeMyMemories will update the effective date and provide any notice required by law or App Store rules.

20. Business Transfers

If FreeMyMemories is involved in a merger, acquisition, reorganization, asset sale, financing, bankruptcy, or similar transaction, these Terms and information FreeMyMemories controls can transfer as part of that transaction. Local Memories and app data FreeMyMemories never receives are not in FreeMyMemories possession to transfer.

21. Disclaimers

FreeMyMemories is provided "as is" and "as available" to the maximum extent permitted by law.

To the maximum extent permitted by law, FreeMyMemories disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, reliability, availability, security, compatibility, and data integrity.

FreeMyMemories does not promise uninterrupted operation, error-free operation, perfect security, compatibility with every export, accuracy in any metadata field, recovery of deleted content, preservation of any content, repair of any file, successful import, successful export, successful restore, successful purchase restore, permanent feature availability, permanent country availability, or compatibility with future versions of iOS, Apple services, Snapchat exports, third-party hosting, devices, backups, Photos, Files, email, or other services.

FreeMyMemories does not promise that export links, signed URLs, Snapchat export formats, Apple services, Google Cloud Storage-style media URLs, cloud services, device storage, backups, Photos, Files, email, or other services will remain available, accurate, complete, secure, unchanged, or recoverable.

Some jurisdictions do not allow certain disclaimers. Those disclaimers apply only to the maximum extent permitted by law.

22. Liability

To the maximum extent permitted by law, FreeMyMemories, its owner, and its authorized representatives will not be liable for direct, indirect, incidental, special, consequential, exemplary, punitive, enhanced, statutory, or multiple damages, or for loss, deletion, corruption, inaccessibility, incompleteness, or inaccuracy of data, Memories, content, media, metadata, files, links, URLs, exports, backups, records, receipts, diagnostics, device storage, cloud storage, Photos copies, Files copies, email copies, third-party copies, profits, revenue, goodwill, reputation, use, business opportunity, or expected benefit, whether based on contract, tort, negligence, strict liability, warranty, statute, product liability, consumer-protection theory, privacy theory, or any other legal theory.

To the maximum extent permitted by law, FreeMyMemories, its owner, and its authorized representatives will not be liable for import failure, export failure, parsing failure, restore failure, purchase-restore failure, entitlement failure, refund/revocation effects, device failure, storage failure, backup failure, iCloud behavior, Photos behavior, Files behavior, email behavior, Apple behavior, Snapchat behavior, Google Cloud Storage-style media URL behavior, network behavior, third-party service changes, expired links, unavailable exports, missing metadata, inaccurate metadata, unavailable content, deleted content, corrupted content, incomplete content, or inability to recover data.

To the maximum extent permitted by law, FreeMyMemories' total liability for claims relating to the app, support, or these Terms will not exceed the greater of the amount you paid for FreeMyMemories during the twelve months before the claim or US $50.

This limitation does not limit liability that cannot be limited under applicable law, including fraud, willful misconduct, gross negligence where it cannot be limited, statutory consumer remedies, privacy or data-protection rights, and other non-waivable rights.

23. Indemnity

To the extent permitted by law, you agree to indemnify FreeMyMemories from third-party claims, damages, liabilities, costs, and expenses caused by your unlawful misuse of FreeMyMemories, your intentional or material violation of these Terms, your violation of law, your infringement or violation of third-party rights, or your export, external sharing, submission, sending, or other use of content outside the app in breach of these Terms or applicable law.

FreeMyMemories will give reasonable notice of any claim for which it seeks indemnity, allow your reasonable participation in the defense where appropriate, and not settle in a way that imposes personal liability on you without your consent. This section does not apply to claims caused by FreeMyMemories' own unlawful conduct, negligence, or breach, and it does not apply where prohibited by consumer protection law.

24. Disputes

These Terms do not impose an arbitration agreement, class-action waiver, jury trial waiver, or exclusive court selection clause. Any dispute or claim is handled under applicable law, Apple's applicable App Store terms, the Apple Standard EULA where it applies, and non-waivable consumer protections that apply where you live. If a court or regulator says a provision cannot apply to you, that provision is limited only to the extent required, and the rest of these Terms remain in effect.
